All property is sold "as is" and neither Town & Country nor the consignor/estate makes any guarantees, warranties or representations, expressed or implied as to the authentication of authorship, physical condition, size, quality, rarity or provenance. No statement anywhere, whether oral or written shall be deemed a guarantee or warranty. Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it has been repaired or restored. Any condition statement is given as a courtesy to the client. We are offering our professional opinion. We attempt to submit condition reports in the description. However, the absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Town and County Auctions of Houston shall have no responsibility for any error or omission regarding an item's condition.

We reserve the right to withdraw any property before the sale.

A buyer's premium of 15% of the successful bid price will be added thereto and is payable by the purchaser as part of the total purchase price.

If we are prevented by fire, theft, or any other reason whatsoever from delivering any property to the purchaser or a sale otherwise cannot be completed, our liability shall be limited to the sum actually paid, therefore by the purchaser, and shall in no event include any compensatory, incidental or consequential damages.

Texas residents are required to pay sales tax in the amount of 8.25% unless exempt by law.

All purchases must be paid for within three business days following the auction. We accept Mastercard, Visa, and Discover with a $50.00 minimum. Items paid for by personal check will be held until check clears our bank.

Your bid is a binding contract and if you are the high bidder, you are obligated to complete the transaction and pay the buyer's premium.
